ELLINWOOD UNDERGROUND CITY FOUNDATION
RELEASE AND WAIVER OF LIABILITY/INDEMNITY AGREEMENT
EVENT: HALLOWEEN HAUNTED HOUSE 2025
IN CONSIDERATION of being permitted to enter, for any purpose, the building, restrooms,
walkways, parking areas, offices, and any other areas appurtenant to the activity/event area, or
being permitted to participate in, observe, volunteer for, work for, or for any purpose attend such
activity/event, EACH OF THE UNDERSIGNED PERSONS, for himself/herself, and on behalf
of his/her personal representatives, heirs, and next to kin, acknowledges, agrees, and represents
that he/she has, or will immediately upon entering any of such activity/event areas, and will
continuously thereafter, inspect such activity/event areas and all portions thereof which he/she
enters and with which he/she comes into contact, and he/she does further warrant that such event
areas are suitable for the use thereof and that he/she finds and accepts the same as being safe and
reasonably suited for the purposes of their use, and he/she further agrees and warrants that if, at
any time, he/she is in an activity/event area and feels unsafe or becomes aware of an unsafe
condition on the premises, that he/she will immediately advise those in charge of such
activity/event and will immediately leave the event area.
1. THE UNDERSIGNED HEREBY RELEASES, WAVIES, DISCHARGES, AND
COVENANTS NOT TO SUE The Ellinwood Underground City Foundation, or any of its
employees, volunteers, owners, officers, board members, agents, or affiliates (hereinafter
collectively referred to as “Releasees”) and hereby releases them from all liability to the
undersigned, his/her person, and his/her property, up to and including injury resulting in
death of the undersigned, whether caused by negligence of the Releasees or otherwise,
while the undersigned is in or upon the activity/event area, and/or participating in,
observing, volunteering for, working for, or for any purpose attending the activity/event.
2. THE UNDERSIGNED HEREBY AGREES TO INDEMNIFY, SAVE, AND HOLD
HARMLESS the Releasees and each of them, individually, from any loss, liability,
damage, or cost he/she may incur due to the presence of the undersigned in or upon the
event area or in any way participating in, observing, volunteering for, working for, or for
any purpose attending the activity/event and whether caused by the negligence of the
Releasees or otherwise.
3. THE UNDERSIGNED HEREBY ASSUMES FULL RESPONSIBILITY FOR AND
RISK OF BODILY INJURY, DEATH, OR PROPERTY DAMAGE due to his/her
participation in the activity/event, conditions upon or within the activity/event areas,
whether due to the negligence of Releasees, or otherwise, while the Undersigned is in or
upon the event area or in any way participating in, observing, volunteering for, working
for, or for any purpose attending the activity/event.
EACH OF THE UNDERSIGNED persons expressly acknowledges and agrees that the activities
of the event are potentially dangerous and involve risk of injury, up to and including serious
injury and/or death and/or property damage. EACH OF THE UNDERSIGNED persons further
expressly agrees that the forgoing release, wavier, and indemnity agreement is intended to be as
broad and inclusive as is permitted by the law of the state of Kansas in which the activity/event is
conducted and that if any portion thereof is held invalid, then it is agreed that the balance shall
continue in full legal force and effect.
THE UNDERSGNED HAS READ AND VOLUNTARILY SIGNS THE RELEASE AND
WAIVER OF LIABILTY AND INDEMNITY AGREEMENT, and further agrees that no oral
representations, statements, or inducements apart from the foregoing written agreement have
been made.
